Terms of Sale

The owner of the online store Playwell.ee (hereinafter referred to as the “Online Store”) is SwampFox OÜ (registration code: 14841231), located at Nurme, Vahi Village, Harku Parish, Harjumaa, Estonia.

Terms and conditions apply to the purchase of goods from the online store.

Information about the product and pricing

The prices of products sold in the online store are indicated next to the products.
A fee for delivery will be added to the prices of products.
The delivery fee depends on the buyer’s location and the method of delivery.
The delivery fee is displayed to the buyer during the checkout process.
The information about the product is provided directly alongside the product in the online store.

Order processing and validity of the sales contract

To order the goods, you must add the desired products to the shopping cart. To complete the order, fill in the required data fields and choose a suitable delivery method for the products. Then, the screen will display the amount due, which can be paid via bank link or another payment method.
The contract becomes effective upon receipt of the payable amount to the online store’s bank account.
If the ordered goods cannot be delivered due to the product being out of stock or for any other reason, the buyer will be notified at the earliest opportunity, and the paid amount (including delivery costs) will generally be refunded within 1-2 business days. Depending on the payment method, it may take up to 7 business days for the refund to be processed.

Delivery

The buyer covers the shipping costs, and the relevant price information is displayed alongside the shipping method.
We typically ship the goods within 1-3 business days after receiving the order. Occasionally, during promotional periods or peak seasons, shipping may be delayed by up to an additional 2 days.
The final delivery time depends on the chosen shipping method.

Right of Withdrawal

After receiving the order, the buyer has the right to withdraw from the contract concluded in the online store within 14 days without stating a reason.
The right of withdrawal does not apply if the buyer is a legal entity.
To utilize the 14-day right of withdrawal, the ordered goods must not be used in any way other than is necessary to ensure the nature, characteristics, and functioning of the goods, as permitted in a physical store for testing.
If the goods have been used for purposes other than necessary to ascertain their nature, characteristics, and functioning, or if there are signs of use or wear, Playwell.ee reserves the right to reduce the refund accordingly based on the decrease in the value of the goods.
To return the goods, a statement of withdrawal from the purchase of the goods must be submitted, the form of which can be found here, and sent to the email address info@playwell.ee no later than 14 days after receiving the goods.
The buyer is responsible for the costs of returning the goods, except in cases where the reason for return is that the returned item does not correspond to what was ordered (e.g., incorrect or defective item).
The buyer must return the goods within 14 days following the submission of the statement of withdrawal or provide proof that they have returned the goods to the carrier within the aforementioned period.
Playwell.ee will refund the buyer without undue delay upon receiving the returned goods, but no later than 14 days from the date of receiving the statement of withdrawal, all fees received from the buyer under the contract.
The online store has the right to refuse refunds until it has received the goods subject to the contract back or until the buyer has provided proof of returning the goods, whichever occurs earlier.
If the buyer has expressly chosen a delivery method other than the least expensive type of standard delivery offered by the online store, the online store is not required to refund the consumer for any additional cost exceeding the cost of standard delivery.
The online store has the right to withdraw from the sales transaction and demand the return of the goods if the price of the goods in the online store has been significantly marked below the market price due to an error.

The Right to File a Claim

The online store is liable to the buyer for non-conformity of the goods sold or defects that existed at the time of delivery and which appear within two years from the delivery of the goods to the buyer. During the first year from the delivery of the goods to the buyer, it is presumed that the defect existed at the time of delivery. It is the responsibility of the online store to rebut this presumption.
The buyer has the right to contact the online store within two months of the defect becoming apparent by sending an email to info@playwell.ee.
The online store is not liable for defects that have occurred due to the consumer’s actions or inactions (such as incorrect use, accident, etc.) after the delivery of the goods, or if the defects are due to normal wear and tear resulting from regular use of the item. If the goods purchased from the online store have defects for which the online store is responsible, the online store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the online store will refund the buyer all fees associated with the contract of sales.
The online store responds to the consumer’s complaint in writing or in a form that allows for written reproduction within 15 days.

Dispute Resolution

If the buyer has complaints regarding the online store, they must be sent to the email address info@playwell.ee.
If the buyer and the online store cannot resolve the dispute by agreement, the buyer has the option to turn to the Consumer Disputes Committee. The procedural terms can be reviewed and an application submitted here.
The Consumer Disputes Committee has jurisdiction to resolve disputes arising from contracts concluded between the buyer and the online store. Reviewing the buyer’s complaint in the committee is free of charge. The buyer may also contact the European Union’s online dispute resolution platform.
